Terms of Use — MarkFinance

These Terms of Use (“Terms”) govern the use of the MarkFinance application (“App”), developed by Capucho Labs (“we”, “our”, “us”). By downloading, installing, or using the App, you agree to these Terms.

1. Acceptance of Terms

By using the App, you represent that you are at least 13 years old and that you agree to these Terms in their entirety. If you do not agree, do not use the App.

2. Description of Service

MarkFinance is a personal finance management application that allows you to:

Manage bank accounts, credit cards, and financial transactions
Track income, expenses, transfers, and recurrences
Monitor credit card invoices with installment tracking
Set budgets by category
View reports and charts of your financial overview
Import data from other apps via CSV

The App works offline and, for Premium users, offers cross-device synchronization.

Important: MarkFinance is a financial tracking and management tool. The App does not access real bank accounts, does not perform financial transactions, does not offer financial advice, and does not connect to any financial institution. All data is manually entered by the user.

3. User Accounts

3.1 Registration

To access features such as synchronization and suggestions, you must create an account with an email and password. You are responsible for maintaining the confidentiality of your credentials.

3.2 Local storage

All your financial data is stored locally on your device using SQLite. After logging in, the App works normally even without an internet connection.

3.3 Account deletion

You may request deletion of your account and all associated data at any time by visiting the account deletion page or contacting us at: capucholabs@gmail.com

4. Plans and Subscriptions

4.1 Free Plan

The free plan offers limited access to the App, including up to 2 accounts, 1 credit card, and 3 recurrences, without cloud synchronization, export, or budgets.

4.2 Premium Plan

The Premium plan unlocks all features and is available in monthly (R$ 14.90) and annual (R$ 119.90) options. Prices may vary by region and are subject to change with prior notice.

4.3 Payment and Renewal

Subscriptions are processed by the Apple App Store or Google Play Store. Renewal is automatic unless you cancel at least 24 hours before the end of the current period.

4.4 Cancellation

You may cancel your subscription at any time through your account settings in the store (App Store or Google Play). Premium access remains active until the end of the already paid period.

4.5 Refunds

Refunds are governed by Apple App Store or Google Play Store policies. We do not process refunds directly.

5. Acceptable Use

By using the App, you agree to:

Not use the App for illegal or unauthorized purposes
Not attempt to access other users’ data
Not interfere with the functioning of the App or its servers
Not reverse engineer, decompile, or disassemble the App
Not use the suggestions system to submit offensive, discriminatory, or illegal content

6. Financial Disclaimer

MarkFinance is a personal financial organization tool. We are not a financial institution, investment advisor, or accounting service. The information displayed in the App is based solely on data entered by you and does not constitute financial, tax, or investment advice. Financial decisions should be made based on appropriate professional guidance.

7. Intellectual Property

The App, including its code, design, icons, and content, is the property of Capucho Labs and is protected by intellectual property laws. Financial institution logos displayed in the App are the property of their respective owners and are used solely for visual identification purposes. You do not acquire any ownership rights to the App beyond the right to use it in accordance with these Terms.

8. User Content

8.1 Your data

You retain all rights to the data you enter in the App (accounts, transactions, categories, etc.). We grant you full control over your data.

8.2 Suggestions

By submitting suggestions through the App, you grant Capucho Labs a non-exclusive license to use, evaluate, and implement the suggested ideas, without obligation of compensation.

9. Limitation of Liability

The App is provided “as is” and “as available.” We do not guarantee that:

The App will be uninterrupted or error-free
Data will be preserved under all circumstances
Calculations and reports will be accurate in all scenarios
Results obtained will be suitable for tax or accounting purposes

To the maximum extent permitted by law, Capucho Labs shall not be liable for indirect, incidental, or consequential damages arising from the use of the App, including financial decisions based on displayed data.

10. Data Loss

While we take reasonable measures to protect your data, we are not responsible for data loss resulting from:

Device failure or damage
Uninstalling the App without cloud backup
Circumstances beyond our control

We recommend that Premium users keep synchronization active as a backup method.

11. Service Modifications

We reserve the right to modify, suspend, or discontinue the App or any feature at any time, with or without prior notice. We will make reasonable efforts to notify you of significant changes.

12. Changes to Terms

We may update these Terms periodically. We will notify you of significant changes through the App or by email. Continued use of the App after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of the Federative Republic of Brazil. Any dispute shall be resolved in the jurisdiction of the developer’s district.
